Pool Route Sales agrees to the following a.) To contact each potential purchaser (at websites discretion) and furnish a greater explanation of the pool industry prior to providing Buyer with Seller's name and contact number. b.) To be available (at websites discretion) to answer any and all pertinent questions posed by Buyer and/or Seller after initial contact. c.) To be available (at websites discretion) to answer questions during the sale, transition period, training period, guarantee period, etc... d.) To provide (at websites discretion) sample transition letter, information on customer growth, maximizing profits, ancillary income and more. If you have any questions, please send us an email and our staff will be glad to assist. By Clicking "I Agree", the Seller/Advertiser agrees to the following: 1.) For and in consideration for advertising through Pool Route Sales online, I (We), the owner(s) do hereby agree to pay to Pool Route Sales an advertising fee of Ten (10) per cent of the total purchase price as set forth above, or a minimum of $450.00 WHICHEVER is greater, immediately, if any of the following occur. a.) Owner sells, leases, trades or otherwise disposes of any of the accounts to any one referred to Seller or anyone who became aware of the accounts through the advertising of Pool Route Sales within the term of this agreement or within one (1) year of termination of this advertising agreement. 2.) Owner represents and warrants that Owner is now, and hereby agrees to remain, in full compliance with all local, state and federal laws, rules and regulations regarding the operation and sale of the accounts. 3.) Owner understands and hereby acknowledges that all facts, figures and other information set forth above have been provided to Pool Route Sales by Owner, and that Pool Route Sales will rely upon Owner's representations of such facts, figures and other information when advertising and promoting the accounts to potential purchasers, without making an investigation into the accuracy of such representations by Owner. Therefore Owner hereby represents and warrants that the facts, figures and information set forth above are true and accurate, and hereby agrees to save, hold harmless and indemnify Pool Route Sales, its owners and employees, against any and all claims, demands, causes of action, costs and expenses, including reasonable attorneys' fees, arising out of a breach of this warranty.
